Driving without due care and attention (careless driving)
Careless driving is one of the most wide-ranging driving offences. It covers many different types of driving behaviour including careless manoeuvres, driving into another care, being in the wrong lane, driving too close to another vehicle or even clipping a kerb. It includes driving that results in an accident as well as driving that doesn’t cause another driver to take evasive action. The potential penalties for a careless driving conviction reflect the wide scope of the offence, from a fixed penalty ticket and three penalty points to disqualification.
The wide scope of the offence can often be confusing, so it is important that you contact McGovern Reid as early as possible. Our expert team of road traffic specialists can assist you and help you protect your licence.

The offence of careless driving is found in section 3 of the Road Traffic Act 1988. It is committed when someone drives without due care and attention or without reasonable consideration for other people. Driving without due care and attention is defined as driving in a way that falls below what would be expected of a competent and careful driver. The standard is, therefore, lower than a charge of dangerous driving (which is driving that falls far below what would be expected), although it is also assessed both objectively and according to any circumstances that the accused was aware of. Driving without reasonable consideration is defined as driving in a way that inconveniences other persons.
