Children’s Referrals and Panel Hearings

Children’s Referrals and Panel Hearings McGovern Reid are regularly instructed by parents, children and other “relevant persons” in respect of Children’s Referral Hearings which are held at the Sheriff Court. We understand that sometimes families experience significant difficulties where relationships can become strained and difficult to maintain. It is often during these times that the Children’s Reporter become involved.

There are a number of grounds of referral which may result in the Children’s Reporter instigating proceedings including lack of parental care, evidence that the child is suffering from sexual abuse, the child having a close connection to someone who has carried out domestic abuse, the child has committed a criminal offence, the child is beyond the parent’s control or the child is not attending school.

McGovern Reid have a growing practice in representing children, parents and grandparents at Children’s Panels. The Panel is convened to make decision regarding a child’s welfare, and they can impose legally binding decisions including ordering the child to be subject to a Compulsory Supervision Order for a period time and regulating how often the child sees their parents.

It is often the case that the Children’s Reporter becomes aware of families as a result of the social work department.

McGovern Reid regularly challenge social workers at panels, if instructed to do so and ensure that our clients’ side of the story is heard by the Panel. We will defend your rights fearlessly both at the Panel and, if necessary, at Court.

McGovern Reid also represent clients whose cases have been referred to the Sheriff Court for Proof. When a case is referred to the Sheriff Court, the Sheriff will consider the situation and decide whether the grounds of referral are accurate. If the Sheriff concludes that the grounds are accurate, then the matter is remitted back to the Children’s Panel. However, it is open to the Sheriff to dismiss the case if she is not satisfied that the grounds have been established.
