How many drinks can I have before I drive?

It is impossible to determine how many drinks an individual can have that will put them over the legal limit, there are a number of factors which must be taken into consideration, including:

  • Weight and metabolism
  • Age
  • Sex
  • What alcohol you’ve been drinking
  • How much you’ve had to eat recently
  • Stress levels

What punishments can I face?

If you are in charge of a vehicle while above the legal limit, you may face:

  • 3 months’ imprisonment
  • A fine of up to £2,500
  • A possible driving ban

If you are driving, or attempting to drive while above the legal limit, you may face:

  • 6 months’ imprisonment
  • An unlimited fine
  • At least 1-year driving ban
  • A 3-year driving ban if you have been convicted twice in 10 years

Failure to provide a breath, blood or urine samples mean you may get:

  • 6 months’ imprisonment
  • An unlimited fine
  • A 1-year driving ban

Causing death from careless driving while above the legal limit means you may face:

  • 14 years’ imprisonment
  • An unlimited fine
  • At least a 2-year driving ban

High risk offenders will not automatically get their licences back.
